Kincumber Quarry is bound by the Australian Privacy Principles, to the extent required by the Privacy Act 1988. This policy outlines how Kincumber Quarry and its Australian subsidiaries (Kincumber Quarry) collect, use and manage personal information.

 

1.1 Personal Information Kincumber Quarry Collects

(a) Kincumber Quarry collects personal information where reasonably necessary for its functions and activities. Personal

information that Kincumber Quarry may hold includes the following:

(i) name, address and contact details;

(ii) date of birth;

(iii) employment and income details;

(iv) bank account details;

(v) details of the products and services provided to an individual by Kincumber Quarry;

(vi) details of an individual’s dealings with Kincumber Quarry, including records of telephone, email and online interactions;

(vii) credit-related personal information (see below).

 

1.2 How Kincumber Quarry Collects Personal Information

(a) Kincumber Quarry collects personal information directly from an individual where reasonable and practical. Kincumber Quarry may also collect such information from other sources, including:

(i) other entities who provide services to Kincumber Quarry related to the products and services provided to an individual by Kincumber Quarry;

(ii) publicly available sources of information;

(iii) an individual’s representatives (e.g. spouse, professional adviser);

(iv) subsidiaries of Kincumber Quarry.

 

1.3 How Kincumber Quarry Uses Personal Information and to Whom it is Disclosed

(a) Kincumber Quarry collects, uses and discloses personal information generally to provide an individual with products and services requested, and to respond to queries. Kincumber Quarry may also use personal information to make an individual aware of Kincumber Quarry’s other products and services or offerings provided by Kincumber Quarry in conjunction with its business partners or associates. Kincumber Quarry may not be able to do these things without the individual’s personal information. Kincumber Quarry may also collect, use and disclose personal information in connection with potential or actual unlawful activity, misconduct or transfers of Kincumber Quarry’s business or assets.

(b) Kincumber Quarry understands the importance of keeping personal information private and only discloses such information to third parties in limited circumstances. Third parties with whom Kincumber Quarry usually exchanges information include:

(i) credit providers and credit reporting agencies;

(ii) an individual’s representatives;

(iii) Kincumber Quarry’s professional advisers including legal, accounting, auditing and business consulting advisers;

(iv) government and regulatory authorities;

(v) subsidiaries of Kincumber Quarry.

(c) Kincumber Quarry also exchanges personal information with contractors who manage services provided to an individual on Kincumber Quarry’s behalf, or who provide services to Kincumber Quarry, including:

(i) mailing services;

(ii) billing and debt recovery functions;

(iii) customer injury services;

(iv) marketing functions;(v) website, data management and technology services.

(d) Parties to which Kincumber Quarry discloses personal information may be located in Australia and other countries.

 

1.4 Website usage information and cookies

(a) When you use our website, Kincumber Quarry collects certain standard information that is sent by your browser to our website. This includes technical information, such as your IP address, browser type, operating system, language,

time zone setting, access times and any referring website addresses. We also use Google Analytics to collect this

(b) Kincumber Quarry uses this information to administer our website and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes. Kincumber Quarry also collects certain information to provide users with a personalised experience when visiting our websites.

(c) Through the use of a ‘cookie’, Kincumber Quarry can record information about your visit to our website including the

clickstream to, through and from our site (including date and time), the pages visited, page interaction information

and methods used to browse away from the page. This information is used anonymously and in aggregate, and is

collected and logged for statistical purposes. Through analysis of these records, Kincumber Quarry is able to provide an

improved service when users revisit our websites.

1.5 How Kincumber Quarry Stores Personal Information

(a) Kincumber Quarry stores personal information at its own premises and with the assistance of its service providers. Kincumber Quarry maintains strict procedures and standards and takes a range of steps to prevent unauthorised access to, or disclosure of, personal information and protect an individual’s information from misuse or loss. Once an

individual’s information is no longer needed by Kincumber Quarry, reasonable steps are taken to destroy or de-identify it.

(b) We take the security of your personal information seriously. All reasonable steps are taken to ensure that all

information is treated confidentially, kept secure and protected against unauthorised use and is maintained only for

the purpose for which it is intended.

 

1.6 Use of your information outside Australia

(a) We do not normally send information overseas, but we are an organisation with international operations and

we utilise international software providers. There may be the circumstances that require us to disclose your data

to our related entities or persons who provide us with services who are located overseas.

(b) Some of the organisations to which we may disclose your personal information are situated outside of

Australia. In order to meet your requirements, we may need to transfer your personal information to these

countries. We will take all reasonable steps to ensure that any organisation to whom we release your information

will comply with the Australian Privacy Act 1988.

 

1.7 Accessing and updating personal information

In most cases an individual can gain access to or update personal information held by Kincumber Quarry. To make a request to access or update personal information held by Kincumber Quarry, contact Kincumber Quarry in writing. Kincumber Quarry may need to verify your identity. Kincumber Quarry may charge a fee to cover the cost of retrieving and copying requested information.

 

1.8 Direct Marketing

We may use your personal information to notify you of services that we may be able to offer you from time to time.

We do not sell, licence or, in any other way, distribute your personal information to any other company for the

purpose of direct marketing and will not do so without your express written consent. You may opt out of receiving

any publications, newsletter or other marketing product at any time.

If an individual believes that Kincumber Quarry has breached its privacy obligations or that individual’s privacy rights in any way, a complaint can be made to the Privacy Officer (see contact details below).

Kincumber Quarry will endeavour to act promptly in response to a complaint.

CREDIT REPORTING TERMS

1.12 Customer Credit

Kincumber Quarry sometimes provides products and services to customers on credit. In connection with a credit application and the ongoing management of the credit arrangement, Kincumber Quarry collects, uses and discloses consumer credit-related personal information described below (credit-related personal information), including information from credit reporting bodies (CRBs).

 

1.13 What types of credit information do we collect and hold?

(a) Kincumber Quarry may collect and hold any types of credit-related personal information about an individual permitted under the Privacy Act, including:

(i) name, sex, date of birth, driver’s licence number, employer and three most recent addresses;

(ii) confirmation of previous information requests to CRBs made by other credit providers and credit insurers about

the individual;

(iii) details of previous credit applications, including the amount and type of credit and credit limit;

(iv) details of current and previous credit arrangements, including credit providers, start/end dates and certain

terms and conditions;

(v) permitted payment default information, including information about related payment arrangements and

subsequent repayment;

(vi) information about serious credit infringements (e.g. fraud);

(vii) information about adverse court judgments and insolvency;

(viii) repayment history;

(ix) information from conversations with other Credit providers;

(x) personal or business-related insolvency information;

(xi) publicly available information about the individual’s credit worthiness;

(xii) any credit score or credit risk assessment indicating a CRB’s or credit provider's analysis of the individual’s

eligibility for consumer credit.

(b) This information may include information about an individual’s arrangements with other credit providers.

(d) Under the Privacy Act, individuals may request CRBs not to:

(i) use their credit-related personal information to determine their eligibility to receive direct marketing from credit

providers; and

(ii) use or disclose their credit information, if they have been or are likely to be a victim of fraud.

 

1.14 Why we collect and how we use your credit information

(a) In addition to the ways for using personal information mentioned in our Privacy Policy above, we may also use

your credit information to

(i) to assess relevant credit or guarantee applications;

(ii) assess whether to securitise our credit arrangements with you.

(iii) manage and review the credit or guarantee

(iv) produce assessments and ratings in respect of the individual’s credit worthiness

(v) enable our team or a credit insurer to assess the risk of providing insurance to us or to address our contractual

arrangements with the insurer;

(vi) assess whether to accept a guarantor or the risk of a guarantor being unable to meet their obligations;

(vii) consider hardship requests;

(viii) exchange credit-related personal information with guarantors, debt buyers and other credit providers

(ix) collect overdue payments

(x) assign debts,

(xi) consider any new application for, or to extend or vary credit, seek to change a credit limit, or at such other

times that Kincumber Quarry may determine to check your ongoing credit worthiness.

 

1.15 How we collect and hold your credit information

(a) Kincumber Quarry will collect your credit information from details included in your application for credit (whether paper based, phone or electronic). The other main sources for collecting and assessing credit information are;

(i) your co-applicants as well as your guarantors/proposed guarantors;

(ii) directors and officers of your business or company

(iii) credit reporting bodies and other credit providers

(iv) your accountant,

(v) trade referees;

(vi) your agents and other representatives like your referrers, brokers, solicitors;

(vii) organisations that help us to process credit applications;

(viii) organisations that check the security you are offering such as valuers;

(ix) bodies that issue identification documents to help us check your identity; and

(x) our service providers involved in helping us to assess credit applications, provide credit or to administer credit products, including our debt collectors, accountants and our legal advisers.

(b) We will hold your information within our credit system. Kincumber Quarry has multinational sites and uses internationally based software to store your data. Your information may be shared or accessed, were necessary and relevant, by us or other Kincumber Quarry entities overseas. We will ensure that parties who hold your data comply with privacy law equal to or better that those imposed under the Privacy Act, 1988.

 

1.16 Sharing your credit information

(a) Kincumber Quarry may exchange information about you with a credit reporting body if you are applying for credit; or you have obtained credit from us; or you guarantee or are considering guaranteeing the obligations of another person

to us; or you are a director of a company that is a credit applicant or guarantor. This may include information about

the date you opened (and closed) a credit account, the account type, the credit limit, your repayment history, any

temporary or permanent hardship arrangements and details relating to any defaults or serious credit

infringements. When we give your information to a credit reporting body, it may be included in reports that the

credit reporting body gives other organisations (such as other lenders) to help them assess your credit worthiness.

(b) Some of that information may reflect adversely on your credit worthiness, for example, if you fail to make

payments or if you commit a serious credit infringement (like obtaining credit by fraud). That sort of information

may affect your ability to get credit from other lenders.

(c) We do not sell, license or otherwise transact in your information. It is used exclusively for the purposes set out

herein.

 

1.17 How to access your credit eligibility information

(a) You can request access to the information we hold on you. Where you request access to credit information

about you that we obtained from a credit reporting body (or data that we have derived from such information), we

will

(i) provide you with access to the information provided to us generally within 14 days (unless unusual circumstances apply); and

(ii) ask you to check with credit reporting bodies what information they hold about you to ensure that our

information is accurate and up-to-date.

(b) If we are unable to give you access, we will tell you why in writing. If concerns you have about your credit

eligibility information are not resolved to your satisfaction, you can lodge a complaint with the Office of the

Australian Information Commissioner. Contact details are provided below.

1.18 Correcting your credit information

(a) If you believe that credit information about you is incorrect, you can apply to have it corrected. The most

efficient way for you to make a correction request is to contact the organisation which made the mistake.

(b) When you make a correction request in relation to information held and disclosed by Kincumber Quarry, we will assess your request and advise whether we agree that a correction should be made. Whether we’re able to correct the

information or not, we’ll let you know within five business days of our decision. If we do not agree to the correction,

we will provide reasons. If we agree to a correction, we’ll also let the relevant third parties (such as credit reporting

bodies) know as well as any other third parties that you tell us about. If there are any instances where we can’t do

this, then we’ll let you know in writing. If your concerns are not resolved to your satisfaction, you can lodge a

complaint with the Office of the Australian Information Commissioner. Contact details are given below.

 

1.19 Complaints

(a) We will let you know how we will deal with your complaint within seven days or you contacting us with an issue.

If we can’t fix things within 30 days, we’ll let you know why and how long we think it will take. We may also ask you

for an extension of time to fix the matter. If you have any unresolved concerns, you may complain to the Office of

the Australian Information Commissioner.

(b) If your complaint relates to how we used or disclosed, or handled your access and correction requests, you

may take your complaint directly to the Office of the Australian Information Commissioner. You are not required to

let us try to fix it first.

(c) A complaint may be lodged with the Australian Information Commission at Lodge a privacy complaint with us |
